The petitioner has retired on 31.10.2017 and thereafter an order dated 30.12.2019 was passed, whereby a part of amount towards leave encashment was withhold subject to outcome of audit objections. For reference relevant part of impugned order is reproduced hereinafter :- "कक पयया वविषययायांवकत क्रम मम उक्त सन्दवररत पतत्रो कया पपुनरयाविलत्रोकन करनने कया कष्ट करम। शश्री जश्री०सश्री० नयायक तत्कयालश्रीन प्ररयागश्रीय वविक्रय प्रबन्धक, झयायांसश्री (सनेवियावनविकत) कने वविरूद्ध विन वनगम मम उनकने उप ललौवगयांग अधधकयारश्री एवियां प्ररयागश्रीय ललौवगयांग/वविक्रय प्रबन्धक पद पर सनेविया ककी अविधध मम वविवरनन सम्परश्रीकया ऐजनेनन्सययों दयारया लगयाई गयश्री आपधतययों कने अनपुसयार शश्री नयायक पर वनधयारररत ककी गई दनेयतया ककी धनरयावशि कत्रो आपधतययों कने वनस्तयाररत हत्रोनने तक रत्रोक कर शिनेष समस्त उनककी उपयाधजरत अविकयाशि नकदश्रीकरण ककी स्विश्रीकक वत धनरयावशि कया तत्कयाल वनयमयानपुसयार रपुगतयान करनया सपुवननशश्चित करम।" 3. Learned counsel for petitioner submits that subsequently this order was reflected in leave encashment report dated 01.06.2020. Learned counsel further submits that no inquiry is conducted till date and no adverse order has been passed in pursuance of order dated 03.12.2019. Both aforesaid orders are impugned in present writ petition. 4. Sri Dhananjay Awasthi, learned counsel appears on behalf of U.P. Forest Corporation at Lucknow, however, today he is not present before this Court. 5. Learned counsel appearing on behalf of State refers the counter affidavit filed by U.P. Forest Corporation at Lucknow that a part of leave encashment to the tune of Rs. 6,34,872/- was withheld on basis of an audit objection, however, he fails to show any reference that any specific order was passed or whether any proper inquiry was conducted or not, considering petitioner has already retired. 6. I have considered the above submissions and perused the record. 7. In absence of any specific order whether on basis of audit objection, any inquiry was conducted to withhold the part payment towards leave encashment, otherwise also no legal provisions brought on record on behalf of respondents to withhold the amount due towards leave encashment, accordingly, writ petition is disposed of with an observation that amount so withhold shall be released in favour of petitioner within four weeks except if any inquiry is initiated in accordance with law, taking note of Article 351(a) of Civil Services Regulations. 8. Since counsel for respondent Nos. 2 to 4 does not appear earlier also, therefore, a cost of Rs.1000 is imposed each on respondent Nos.2 to 4 to be paid in the office of Allahabad High Court Bar Association within three weeks. 9.
