Case No. 171/2025, instituted for the offence under Sections 103(1), 3(5) of B.N.S., 2023 and Section 27 of the Arms Act.
Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused person, has committed murder of Rohit Kumar Singh; as Rohit Kumar Singh became intimate with his married sister. It is submitted that the allegation against the petitioner is false and there is no eye witness to the occurrence and only because, the petitioner was seen somewhere near the place of occurrence along with the co-accused, he threatened the deceased to kill sometime, before the occurrence, hence, on that basis, the petitioner has been implicated in this case. It is next submitted that so far three witnesses have been examined during the trial and none of them, has stated that the petitioner has committed any crime and there is no
ballistic report in the record to suggest that the alleged bullet, which was recovered from the place of occurrence, was fired from any fire arm in possession of the petitioner or used by the petitioner. It is next submitted that the petitioner has been in jail custody since 04.11.2024, as mentioned in para 16 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with the trial of the case. It is next submitted that the co-accused with similar allegations have already been admitted on bail by this court vide order dated 15.07.2025 passed in B.A. No. 5747 of 2025 and order dated 23.06.2025 passed in B.A. No. 4860 of 2025 hence, the petitioner may be admitted on regular bail. Learned P.P. opposed the prayer for regular bail . Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1.
