Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Krishna Mohan Asthana, learned counsel for respondent no.4. 2. The petitioner by means of present writ petition has prayed for following relief: "Issue a writ order or direction of suitable nature for quashing the order/letter dated 28.02.2025 issued by the Manager, Rashtriya Inter College, Jabda, District Amroha (Annexure No.4 to the petition) and the alleged resolution o the committee of the management dated 27.12.2024 if any. Issue a writ order or direction of suitable nature commanding the respondents including the District Inspector of Schools, Amroha not to permit the respondent committee of management to proceed with the fresh election of the committee of management in the institution without first enrolment of the petitioner as one of the member to the general body of the institution in pursuance his application." 3. The grievance of the petitioner is that the Committee of Management of Rashtriya Inter College, Jabda, District Amroha has refused to accept the membership of the petitioner. 4. A preliminary objection has been raised by learned counsel for the respondents that the writ would not lie against the order of the Manager of the College refusing to induct the petitioner since no statutory function has been discharged by the Manager of the College in refusing to accept the membership of the petitioner, therefore, the writ petition is not the remedy. 5. Accordingly, writ petition is dismissed with liberty to the petitioner to avail appropriate remedy available to him under the law.
