Learned counsel for petitioners submits that petitioner No. 1, according to the complaint, is not the person involved in the alleged attack on the complainant. The investigation in the case is stated to be in progress. Instead of having the statement recorded before the Investigating Officer, the petitioners have filed the present writ petition. At this stage, however, learned counsel for the petitioners seeks permission to withdraw the petition, with liberty to approach the concerned IO for recording of their statement in the course of further investigation. IO, who is present in the Court submits that as and when the petitioners approach him, he shall record their statement in accordance with law. In view of the above, the writ petition is dismissed as withdrawn, with liberty to the petitioners to approach the concerned IO, who shall, after __________ recording their statement, proceed further in the matter in accordance with law.
