1. Heard Mr. Jitendra Gupta, learned counsel for the petitioner. Also heard Mr. Malay Jain, learned Panel Lawyer for the respondents/ State. 2. The petitioner has filed this petition praying for following relief:-
“It is, therefore, prayed that the FIR and the Final Report lodged against the Applicant namely Amit kumar Gupta at Police Station Mahila Thana, District Durg, C.G, bearing FIR No. 19/2025, for the offence under Section 85 of the BNS by the Non-Applicant No.2 namely Smt.Menka Kehsrwani dated 10/4/2025, and the proceedings before the Learned Judicial Magistrate First Class, Durg, C.G bearing Crminal case No.RCC/22156/2025 may kindly be set-aside/quashed.”

At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as order taking cognizance has not been challenged to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court for
3 wasting precious time fo the court and the said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.). 6.
