Sumi Dey Versus The State of West Bengal & Ors.
Mr. Debasis Sur Mr. Hare Krishna Halder Mr. Dilip Kumar Das …for the Petitioner
Mr. Koushik Chatterjee Mr. Mousam Sharma …for the Private Respondent
Mr. Gautam Lahiri …for the Respondent Nos. 2 to 5
1. There are multiple litigations pending between the parties filed by the petitioner.
2. The grievance of the petitioner in this writ petition is directed against alleged non-consideration of a representation dated 8th May, 2025. It has been agitated on behalf of the petitioner that the demand for a trade licence has been unjustifiably refused by the respondent Municipality.
3. On behalf of the municipality, it is vehemently contended that the petitioner is simply playing games with the Court and is deliberately procrastinating the demolition on false and frivolous pretexts. In particular, the repeated filing of representations on the plea for a trade licence is to only thwart the demolition proceeding.

In view of the submissions made on behalf of the parties, WPA 18192 of 2025 is disposed of by directing the concerned Municipality being the respondent No. 2 and 3 respectively to consider and dispose of the representation dated 8th May, 2025 within a period of four weeks from the date of communication of this order after granting an opportunity of hearing to all the parties.
5. It is made clear that there has been no expression on the merits of the case and all issues are left open to be decided by the Municipality strictly in accordance with law. The Municipality will also give sufficient weightage to their own letter dated 6th May, 2025 directing closure of the illegal shop being run by the petitioner.
6. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
