This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue an appropriate Writ an order or the direction more particularly the writ of mandamus declaring the issuance of certificate by respondent No.3 dated 27.04.2018 declaring the petitioner as Medically fit to perform the duties as Constable being illegal, arbitrary and contrary to the discipline of the Medical Code of Conduct and the hierarchy of Learned Experts and set aside the same and consequently direct the respondents to refer the petitioner to the Medical Board to be constituted according to the Rules and in the event of the petitioner being rendered unfit he may be accommodated with a suitable alternative employment in the Ministerial side in terms of the extent Rules of the department and pass…”
2. Learned Central Government Counsel would submit that the relief in the present petition has become infructuous since the person is removed from service with effect from 31.05.2019.
3. None represented on behalf of the Petitioner. The Proceeding Sheet dated 28.03.2025 also shows none represented for the Petitioner. The Matter is directed to be listed today under the caption “for dismissal”. Despite the matter is listed under the caption “for dismissal” in the list today, none represented the matter. It appears they have no interest in prosecuting the matter.
4. In that view, the Writ Petition is dismissed for Non-prosecution. No order as to Costs.
