GP FOR ENERGY (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... a Writ of Mandamus, declaring the action of the respondents in not providing employment to the petitioner herein under land looser category while appointing other land oustees in Rayalaseema Thermal Power Project (R.T.P.P.) inspite of petitioner is being eligible as per scheme issued in. G.O.Ms.No. 98 dated 15-04-1986 as illegal, arbitrary, violative of Article 14 and 16 of Constitution of India.” 2. When the matter is taken up for hearing, learned Standing Counsel for APGENCO would submit that the Petitioner herein is a land loser and the Department acquired the land of the Petitioner assuring to provide employment to him in Rayalaseema Thermal Project. Learned Standing Counsel would further submit that, as per the notification, 177 posts were notified and out of them 88 posts were meant for land-losers. But, the name of the Petitioners is at Sl.No.294 and recruitment is also over. 3. Sri K.Venkat Reddy, learned counsel for the Petitioner would submit that the petition may be disposed of by giving liberty to the Petitioner to participate in the coming recruitments and also let there be a direction to the Respondents to consider the case of the Petitioner as per his eligibility and turn. 4. Considering the submissions made, the Writ Petition is disposed of with a liberty to the Petitioner to participate in the coming recruitments. Respondents are directed to consider the case of the Petitioner as per his eligibility. There shall be no order as to costs.
