By the present writ petition, the petitioner is challenging the order dated 04/09/2024 (Annexure P/1) passed by the Collector, Mohala-Manpur-Ambagarh Chowki and the order dated 10/05/2024 (Annexure P/2) passed by the SDO (Revenue), Mohala. 2. Learned counsel appearing for the State submits that after the remand of the matter to the SDO (Revenue), the final order has been passed by the SDO on 09/01/2025, therefore, the present writ petition is not maintainable as of now. 3. Looking to the subsequent development as stated by the learned counsel for the State, the counsel for the petitioner seeks permission of this Court to withdraw this petition with a liberty to file an appeal under Section 91 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 before the Collector. 4. I have heard learned counsel for the parties and perused the documents. 3 / 3 5. In view of the above submissions made by the parties, the present writ petition is dismissed as withdrawn with the liberty to the petitioner as stated supra. In the event of filing of such an appeal before the appellate authority/Collector, the Collector shall consider and decide the same within a period of 10 days from the date of filing of such an appeal.
