THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY gB±MINAL PETITION NO_:±Q4PE£g2± ORDER: This Grim-lnal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.85/2024 of ChittOOr, G,R,P, Guntakal. 2, A case has been registered against the Petitioner and Others for the offences under sections 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act. 3. The case of the prosecution iS that: 11'11|2024 at 6|00 pm, during routine inspection conducted by RPSl of Chittoor RPS at Chittoor Railway Station Plat form nO,2, three unclaimed bags were discovered in s2 coach Of Train nO|16381- Despite enquiries, no passengers Claimed the ownership Of the bagS® upon opening the bags, police found 22 kgs Of ganja and One Aadhar card belong'lng to Al and a cloak room slip along With Phone number Of A1' On 14,ll.2024, on cred-lble information, POliCe Party reached Renigunta railway station and found A2 and A3 in Suspicious circumstances and on enquiry they disclosed their identity particulars and they voluntarily confessed their involvement of illegal transportation 2 of ganja. police -arrested them and got them remanded to judicial custody. On 19.ll.2024, Al was apprehended by the police. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is at fag end and some more witnesses are yet to be examined. 6. A perusal of the material available on record goes to showthatthe contraband that is allegedly seI-Zed in this crI®me iS about 22 kgs of ganja and the petitioner was arrested on 19.ll.2024. Since then he is in judicial remand. Learned Assistant Public Prosecutor submitted that investI'gatiOn iS completed and Charge sheet could not be filed for want of inventory and RFSL Report. 7. In view of the aforesaid facts and circumstances of the case, this court is I-nclined to grant bal'I to the petitioner herein, on the following conditions. (i) The petitioner/Al herein sha" be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satI-SfaCtl'On Of the learned I Addl-tionaI District and sessions Judge, Nellore; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and o5.00 p.m., till filing of charge sheet. 8.
