C MP No. 25843 of 2025 This application has been filed for recalling the order dated 23rd September, 2025 and for restoration of main petition to its original position, which was dismissed in default as well as for non- prosecution for absence of Advocate. It has been submitted that due to similarity of name of counsel, representing the petitioner with another counsel, the counsel could not put in appearance on behalf of petitioner, resulting into dismissal of petition. Considering the submissions, which are duly supported by the affidavit of Advocate himself, to be true and genuine, order dated 23rd September, 2025 is recalled and petition i.e. CWP No. 1051 of 2014 is ordered to be restored to the original status with original number. Application stands disposed of. CWP No. 1051 of 2014 Learned counsel for petitioner submits that the Government land in possession of petitioner has been permitted to be exchanged by the competent Authority with his own land. Learned Additional Advocate General is directed to have instructions in this regard from the concerned Authority. The documents related to exchange have been placed on record along with CMP No. 25843 of 2025. List for hearing on 13th November, 2025, as prayed. CMP No. 25844 of 2025 Allowed at this stage and the petitioner is exempted from filing translated/typed copy of Annexure A-2, subject to filing of same within seven days as and when directed to do so.
