Hon'ble Manoj Bajaj,J. Applicant-Hanumant Sachan has filed this petition under Section 407 Code of Criminal Procedure for transfer of Case No. (S.T. No.) 50 of 2021; titled State vs. Sarthak Sachan, arising out of Case Crime No. 463 of 2019, under Section 304/201 IPC and Section 5/27A Arms Act, Police Station Sadar Bajar, District Meerut, pending before Juvenile Justice Board, Meerut to any other Juvenile Justice Board in District Lucknow. Learned counsel for the applicant has drawn the attention of the Court to a complaint dated 9th November, 2020 submitted before Director General of Police, State of U.P. to point out that being a complainant in FIR No. 463/2019 relating to the alleged murder of his niece, it is apprehended by applicant that, if, anything like: accident; abduction; murder attempt or if, the applicant is implicated in some other case, four persons, namely, (i) Vijay Gupta, Sub-Inspector, Police Station Sadar Bajar, Meerut; (ii) Phoolchand Sachan; (iii) Rajesh Sachan and Smita Sachan would be responsible. On this ground a prayer is made for transfer of trial. Concededly, no incident has ever taken place against the applicant- complainant, therefore, considering the application dated 9th November, 2020, which is only an apprehension expressed by the applicant, this Court does not find it to be a fit case for transfer of the trial. Resultantly, the application fails and is hereby dismissed.
