The instant appeal is preferred against the
judgment and order dated 22.10.2013 passed in WPSS No. 1626 of 2013 ‘Reena Arya and Others Vs. State of Uttarakahnd and Others’. By the impugned judgment, the writ petition was allowed in the same terms and observation made in Writ Petition No. 944 of 2011 (S/S) ‘Balwant Singh Others Vs. State of Uttarakhand and Others’ decided on
20.11.2012.

At the very outset, today learned State Counsel would submit that when the impugned judgment was passed, the judgment dated 20.11.2012 in Balwant Singh’s case (supra) had already been stayed by the Hon’ble Supreme Court. He further submits that subsequently, the Hon’ble Supreme Court has finally decided the Balwant Singh’s case (supra) on 17.01.2025. In consequence thereof, the impugned

order is to be complied. He further submits that the matter of the petitioners has already been processed, in accordance with the law. He, therefore, submits that nothing further survives for adjudication in the present appeal, it has rendered infructuous.

Learned counsel for the private respondent as well as learned counsel for respondent no. 6 also states that they have nothing further to submit in the matter.

In view of the statement made on behalf of the learned State Counsel that the impugned judgment has already been complied with by the State Government and is not being assailed any further, nothing survives in this appeal.

The appeal stands disposed of accordingly.
