1. None for the petitioner. Mr Nikhil Vaze, learned Additional Public Prosecutor appears for the State.
2. This is a petition seeking quashing of “enitre Charge-Sheet filed in criminal case I.P.C.3/2023 on the file of Ld. Civil Judge (Junior Division) & J.M.F.C. Pernem vide Exhibit “B” to meet the ends of justice & equity.”
3. Though there is no formal relief to quash the FIR, we take it that the Petitioner intends to quash the FIR as well. However, upon perusal of the records, including the FIR and the impugned chargesheet, we are satisfied that no case for quashing as such is made out. From the perusal of the FIR we cannot say that the ingredients of the offence have not been made out. At this stage, we are required to take into account the allegations of the FIR at their face value. Besides, after investigations which includes the statement at pg 31, which includes the statement of Dr. Neil Rasal, at page 101 of the paper-book, a charge- 12th March 2025 2025:BHC-GOA:422-DB
13-wpcr-56-2024.doc sheet is already filed in this matter. The petitioner would always have an opportunity of urging that no charge need to be framed in this matter. However, we are satisfied that no case for quashing the impugned FIR or the chargesheet by exercising our extraordinary jurisdiction or by invoking our inherent powers under Section 482 of the Cr.P.C is made out.
4. Therefore, by granting the petitioner liberty to seek discharge or oppose the framing of charge in this matter, we dismiss this Petition.
