It has been the case of the petitioner that he entered into an Memorandum of Understanding with “Uttarkashi Jila Sahkari Krayay Vikraya Evam Fal Vipanan Samiti Ltd. Naugaon” (“the joint venture”). But, the joint venture continued for two years and now it is not in existence. The petitioner seeks direction that the future of the joint venture may be decided and, therefore, a prayer is made that that a decision should be taken pursuant to the letter dated 13.09.2019 written by the Secretary, Government of Uttarakhand to the Registrar, Cooperative Societies, Almora.

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner would submit that the petitioner had entered into a joint venture, which remained effective for two years; but, now, no decision has been taken about the continuance of the joint venture.

Learned State Counsel would submit that there were various misrepresentations and concealments made by the
2 petitioner and an inquiry is underway with regard financial misrepresentation and forgery; in the inquiry, the inquiry officer has recommended for investigation by the higher authority or by the Special Investigation Team.

The Statement given by the learned State Counsel is taken on record.

Since with regard to the joint venture, an inquiry is underway, no directions may be issued at this stage with regard to the future of the joint venture. Accordingly, the writ petition deserves to be dismissed at the stage of admission itself.

The writ petition is dismissed in limine.
