In this writ petition, the petitioners have prayed for following reliefs:- 1) For a direction commanding upon the respondents to grant the benefits of 1st MACP in the Grade Pay of Rs.2800/- (Instead of Grade Pay of Rs.2400/) and further to grant the benefits of 2nd MACP accordingly in Grade Pay of Rs.4200/- (Instead of Grade Pay of Rs.2800/-) to the petitioners. (ii) For a direction upon the Respondent No.1 to consider and take a decision on the recommendation of Respondent No.3 contained in Letter No.209/P dated 23.05.2025 (Annexure-7) whereby and whereunder a request has been made to consider the case of the petitioners for grant of 1st MACP in the Grade Pay of Rs.2800/- and 2nd MACP in the Grade Pay of Rs.4200/-. (iii) During the pendency of this writ petition the Principal Secretary, Home, Prison and Disaster Management Department, Government of Jharkhand be directed to take a decision on Letter No.209/P dated 23.05.2025 (Annexure- 7). 3. Learned counsel for the petitioners submits that there is anomaly in payment of the Grade Pay after grant of MACP. He submits that the union has already represented before the respondent No.3- Deputy Inspector General of Police (Personnel), having office at Police Headquarters, Dhurwa, P.O. & P.S.- Dhurwa, Town & District- Ranchi, but the matter is yet to be decided and the respondent No.3 has also requested the Director General of Police, Jharkhand and to the Secretary/Principal Secretary, Home Prison and Disaster Management Department, Dhurwa, Ranchi to consider the case of the petitioners. 4. Considering the nature of the relief as sought for, I direct the petitioners to approach the respondent No.1- Secretary/ Principal Secretary, Home Prison and Disaster Management Department, Dhurwa, Ranchi. Once the representation is filed appropriate decision would be taken as to which grade the members of the petitioners union are entitled to and benefit of MACP should be granted to which pay grade. 5. If it is found that the Grade Pay needs to be corrected or the anomaly needs to be removed, the same should be done and consequential orders should be passed, so that the persons can benefit from the said order. If it found that the claim has got no legs to stand, then the reasoned order rejecting the said claim should be communicated to the petitioners. 6. With the aforesaid observation, the instant writ petition stands disposed of. 7. It is expected that the entire process should be concluded within a period of twelve weeks from the date of receipt of a copy of this order along with the detailed representation.
