The petitioner has been made accused in connection with Jariagarh P.S. Case No. 21 of 2023 (N.D.P.S. Case No.40 of 2023), for the offences registered under Sections 279, 337 and 338 of the I.P.C. and Sections 134, 184 and 187 of the M.V. Act and Sections 20(b)(ii)c of the N.D.P.S. Act, pending in the Court of learned District Additional Sessions Judge-III, Khunti. On 29.05.2023 at about 6:20 P.M., Jariagarh police on the basis of confidential information intercepted a vehicle bearing registration No. OD02R- 9412 from a place near village- Nagda, two persons were apprehended from the said vehicle. On search, 76 packets of cannabis weighing 106.76 kgs. were recovered from the said vehicle. It was submitted that petitioner was neither apprehended at this spot nor anything was recovered from his possession. It was further submitted that name of the petitioner has transpired in confession of co-accused, who was apprehended at the spot. Learned A.P.P. has opposed the prayer for bail and submitted that petitioner has got criminal antecedent. Considering the fact that there is no cogent material against the petitioner on the record, apart from confession of co-accused, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned District Additional Sessions Judge-III, Khunti, in connection with Jariagarh P.S. Case No. 21 of 2023 (N.D.P.S. Case No.40 of 2023). (Ambuj Nath, J.) Jay/-
