JUSTICE GANESH RAM MEENA Order 13/05/2025 This appeal is preferred against the order dated 21.08.2018 passed by the Labour Court and Industrial Tribunal, Ajmer (Civil Jurisdiction) in Civil Misc. Case No. 16/2017, whereby the applica- tion filed under Order 39 Rule 1 & 2 CPC by the present respon- dent No. 1 was partly allowed. Learned counsel for the respondent submits that the present appeal has become infructuous in view of the fact that the original suit has already been decided by the trial Court. Learned counsel appearing for the appellant submits that the appellant is not in his contact. In view of the statement made by learned counsel for the re- spondent, the present appeal is dismissed as having become in- fructuous. However the appellant would be at liberty to move an application for revival of the appeal in case the statement made by counsel for the respondent is found to be incorrect.
