1. Heard Mr. Amit Kumar Sahu, learned counsel for the applicant. Also heard Mr. Ankur Diwan, learned counsel for the respondent.
2. This criminal revision has been filed by the applicant seeking following relief:
“It is therefore, prayed that the Hon'ble Court may kindly be pleased to allow this petition and set-aside
2 the impugned order dated 09-02-2024 passed by the learned family court Mungeli in miss. Criminal case no. 322/2023 and further be please to direct the respondent to pay the maintenance amount so far as it relates to the claim of the petitioner, in the interest of justice.”
3. The present criminal revision is beyond time as has been reported by the Registry.
4. From perusal of application for condonation of delay, it is apparent that the applicant has not given day to day explanation of inordinate delay of 102 days in filing the revision, as such, the revision is barred by delay and laches and is not liable to be entertained.
5. Considering the grounds raised in I.A. No. 01 of 2024, I do not find any good ground to condone the delay of 102 days in preferring the revision.
6. Accordingly, I.A. No. 01 of 2024 is rejected and consequently thereto, the revision is also dismissed.
7. Registrar (Judicial) is directed to transmit the original record to the concerned trial Court within a week from today for necessary information and follow up action.
