M UMA DEVI (CENTRAL GOVT COUNSEL) 3 JS,J W.P.No.6109/2015 The Court made the following ORDER: The present writ petition is filed under Article 226 of Constitution of India, seeking the following relief: “…to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent in not issuing new passport fresh application to the petitioner with correct date of birth as 01.01.1965 instead of 02.02.1950 as highly illegal and arbitrary and pass such other order…” 2. During the course of argument, learned counsel appearing for respondent No.1 submits that the petitioner has to approach competent civil Court seeking decree for correction of date of birth in his passport. 3. On the other hand, learned counsel for the petitioner, in reply, submits that liberty may be granted to approach the competent civil Court for necessary correction in the date of birth of the petitioner’s passport. 4. Considering the submissions of both the learned counsel, this Court feels it appropriate to dispose of the writ petition by directing the petitioner to approach competent civil Court for carrying out necessary correction of date of birth in his passport. 5. Accordingly, the Writ Petition is disposed of. No order as to costs.
