The present writ petition has been filed seeking directions inter alia to take action against the illegal and unauthorized construction being carried This is a digitally signed order. Learned counsel appearing for the petitioner submits that respondent no. 6, who is the owner of Flat No. 205, i.e., third floor, has carried out unauthorized construction over the terrace of Flat No. 205, i.e., on the fourth floor. 3. Responding to the present writ petition, learned counsel appearing for Municipal Corporation of Delhi (“MCD”) has handed over a copy of the Status Report, which is taken on record. 4. Copy of the aforesaid Status Report shall also be supplied to learned counsel appearing for the petitioner, on the Email which is reflected in today’s order. 5. The relevant paragraphs of the Status Report are reproduced as under: “xxx xxx xxx This is a digitally signed order. Further, Work Stop Notice has also been issued to the Station House Officer (“SHO”), Police Station-Sector 23, Dwarka. 8. Accordingly, MCD is enjoined upon to take requisite action after following the due procedure, against the unauthorized construction being carried out in the property in question. 9. Further, the MCD shall ensure that no further unauthorized construction takes place in the property in question. 10. Accordingly, the concerned officials of the MCD with the assistance of SHO, Police Station-Sector 23, Dwarka, New Delhi, shall ensure that no further unauthorized construction takes place in the property in question. 11. This Court notes the statement made by learned counsel appearing for respondent no. 4-BSES Rajdhani Power Ltd., that no fresh electricity connection has been provided to the fourth floor of the property where unauthorized construction is being carried out. 12. The aforesaid statement is taken note of. 13. In case any parties are aggrieved by any action or non-action on the part of the MCD, their rights to seek their remedies in accordance with law, This is a digitally signed order.
