Trivedi, AC to SC-VII ------ 2/04.11.2025 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State. 2. The petitioner is apprehending his arrest in connection with Sahibganj (T) P.S. Case No.25 of 2018, registered for the offence Under Sections 467, 468, 471, 419, 420, 408, 409 of Indian Penal Code, pending before the court of learned Chief Judicial Magistrate, Sahibganj. 3. Learned counsel appearing for the petitioner submits that petitioner happened to be clerk working with Panjab National Bank, Sahibganj and the allegations are made that with the cloned cheque of Jharkhand Secondary Education Project Girls Hostel account, amount has been withdrawn. He then submits that petitioner has nothing to do with the cloned cheque and in the identical situation, Bank Manager has been granted anticipatory bail in ABA No.2524 of 2024 by order dated 18th October 2024. He further submits that petitioner being the clerk has forwarded the cheque for clearance and pursuant to that the Bank Manager has cleared the cheque. He then 2025:JHHC:33070 2 submits that the petitioner has also responded to notice under Section 41-A of Cr.P.C. and complied the same. 4. Learned counsel for the State opposed the prayer and submits that huge amount of the Jharkhand Secondary Education Project Girls Hostel has been withdrawn from the cloned cheque. 5. In view of the above and considering that the Bank Manager had been granted anticipatory bail in ABA No.2524 of 2024 and the petitioner has also replied notice under Section 41-A of Cr.P.C.; I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner above named is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj, in connection with Sahibganj (T) P.S. Case No.25 of 2018, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita, 2023. 7.
