The above contempt case is filed complaining about the non- implementation of the order dated 13.06.2011 in W.P.No.27842 of 2005. Page 3 of 5 SRS,J C.C.No.164 of 2012
2. Heard learned counsel appearing on either side. 3. W.P.No.27842 of 2005 was filed to declare the action of respondents in not paying salary to the petitioner from 01.11.2002 to 18.01.2005. The writ petition was disposed of on 13.06.2011, directing the respondents to consider and finalize the claim of the petitioner by passing an appropriate order, as per law, within two (02) months, from the date of receipt of a copy of the order. 4. In the affidavit, it was pleaded that despite communicating the order dated 13.06.2011 to the respondents, the respondent authorities failed to pay the salary. 5. A counter affidavit was filed on behalf of respondent No.1. It was contended, inter-alia, that the authority requested the petitioner to produce the required documents and claim the amount. The petitioner, neither came to the office nor produced the documents. A legal notice dated 11.10.2012 was issued to the petitioner asking him to come to the office and show the required documents. However, the petitioner did not turn up. 6. Respondent No.2 filed a counter affidavit by annexing the proceedings dated 20.11.2011, wherein, it was stated that the petitioner is entitled to an amount of Rs.91,750/-, in total. The petitioner, in fact, obtained a loan for Rs.61,000/- and the balance amount of Rs.30,750/- will be paid to the petitioner. 7. A reply affidavit filed by the petitioner by denying the averments made in the counter affidavits filed by respondents 1 & 2. 8. Thus, as seen from the counter affidavits filed by respondents 1 & 2, the order dated 13.06.2011 in W.P.No.27842 of 2005, has been complied with. The complaint of the petitioner that the order has not been complied with, is no merit consideration. Page 4 of 5 SRS,J C.C.No.164 of 2012
9. Given the facts and circumstances of the case, the Contempt Case is closed. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
