The learned advocate appears on behalf of the State respondent. None appears on behalf of the petitioners. This is an application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973 filed by the petitioners for quashing of the criminal proceeding being NGR No.906 of 2013 arising out of Dinhata Police Station GDE No.788 of 2013 and 786 of 2013 dated 13.07.2013 under Sections 186/504/506/34 of the IPC pending before the learned Court of Additional Chief Judicial Magistrate, Dinhata. The matter was taken up by the Coordinate Bench of this Court on 17th August, 2015 when direction was given to the petitioners to serve the copy of the revisional application upon the opposite party no.1 through the learned Public Prosecutor and also upon the added opposite party no.2 through registered speed post. There was an order of stay of the proceeding for a period of six weeks or until
2 further orders whichever is earlier. The matter thereafter appeared on 23rd December, 2015 when the interim order was further extended for a period of eight weeks. Subsequently the matter appeared on 2nd December, 2016 when the matter was directed to appear one week after X-Mas vacation on the prayer of the learned counsel for the petitioner. The interim order was not extended. The matter is pending since 2015 and is running in the Warning List since 20.2.2025. In view of the above facts and circumstances, the matter stands dismissed for default. Let a copy of this order be forwarded to the learned court of Additional ACJM, Dinhata, Cooch Behar for information.
