Mr. Amantya Pal, Adv. …for the petitioner The Court:- This is an application for grant of Letters of Administration of the estate left behind by the deceased, as in case of intestacy (i.e. without the Will annexed). The deceased had executed a Will in respect of the immovable property owned by the deceased. Such Will has been probated by an order dated December 15, 2022. There was no disposition as regards the movable assets of the deceased in the Will and as such, this application for grant of Letters of Administration has been filed. The deceased is survived by three legal heirs (being one son and two daughters). The wife of the deceased expired on April 20, 2023 as would be evident from a copy of the death certificate annexed as annexure-“B” at page 12 of the application. 2 One of the three legal heirs (i.e. the son) is the applicant before this Court. The other two (i.e. two daughters) have consented to the grant. Having regard to the above, since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, considering the view of the Department, this application for grant of Letters of Administration is allowed by passing orders in terms of prayer (a) of the application subject to the petitioner furnishing a personal bond for a sum of Rs.6,00,000/- (Rupees Six Lakh only) with two sureties.
