V CH NAIDU 2. BUGULU SREETEJA Counsel for the Contemnor(S): 1. The Court made the following: THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO:6134/2023 ORDER: This contempt case is filed against the respondents for willful disobedience of the orders dated 03.07.2023 passed by this Court in W.P.No.15100 of 2023 which is read as under : “Hence, considering the submissions of the learned counsel for the petitioners, without going into the merits of the case, this Writ Petition is disposed of directing the 1st respondent to consider the request made by the 2nd respondent through Rc.No.E1/5428/MD/APEWIDC/2023 dated 19.05.2023 and take appropriate action within a period of four(4) weeks from the date of receipt of a copy of this order. No costs.” Heard learned counsel for the petitioners and learned counsel for the respondents. 2. Learned counsel for the petitioners submitted that even though this Court specifically directed the respondent No.1 to consider the request made by the respondent No.2 through proceedings dated 19.05.2023, the respondent No.1 has not complied with the orders of this Court. Hence, they are liable for punishment under Section 10 and 12 of the Contempt of Court Act. 3. On the other hand, learned Standing Counsel for the respondent No.2 submits that as per the resolution of the respondent No.2 dated 19.05.2023, respondent No.1 issued proceedings dated 14.08.2023 and directed the respondent No.2 to pass appropriate order by considering the case of the petitioners pursuant to the representation submitted by them, in compliance of the order of this Court dated 03.07.2023. In view of the same, the respondent No.2 again passed fresh order dated 09.10.2023, rejecting the case of the petitioners on the ground that the petitioners have not rendered 5 years of service and they are not entitled for regularization as prayed for. Hence, the case of the petitioners was rejected vide order passed by the respondent No.1 dated 14.08.2023 and order of the respondent No.2 dated 09.10.2023 which indicates that orders of this Court dated 03.07.2023 are complied with as directed. 4. Having considered the submissions made by both the counsel, the order passed by this Court on 03.07.2023 is complied with by the respondents by passing a speaking order on 09.10.2023. Therefore the order of this Court is complied with. Hence the contempt case against the respondents is closed. It is for the petitioner to proceed further in accordance with law. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J 11.02.2025 RSD HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA (closed) CONTEMPT CASE NO:6134/2023 11.02.2025 RSD
