The Court made the following: ORDER: The petitioner is challenging the order of termination vide proceedings Notice No.151/2012/DVC/B4 dated 26.06.2012, issued by the 1st respondent. 2. The petitioner was engaged as Field Assistant on contract basis. While so, the 1st respondent, relying on the evidence of social audit report, issued a show cause notice dated 26.05.2012 calling upon the petitioner to explain as to why action should not be taken against her for the misappropriation of an amount of Rs.16,608/-. After considering the explanation of the petitioner, the impugned proceedings were issued terminating her services. 3. Learned counsel for the petitioner submits that the petitioner has no role as far as misappropriation of funds is concerned, as she does not have the drawing authority. 4. Learned Standing Counsel submits that the petitioner, during the course of enquiry has admitted the misappropriation and also remitted the misappropriated amount of Rs.16,608/-. Considering all these, the impugned proceedings have been issued. 5. It is also submitted by the learned Standing Counsel that the petitioner, if aggrieved by the impugned proceedings, she can approach the Appellate Authority. The petitioner, without approaching the Appellate Authority, straight away chose to file this writ petition. 6. The petitioner has challenged the impugned proceedings without approaching the Appellate Authority. Considering the effective alternative available to the petitioner, this Court is not inclined to interfere with the impugned proceedings. 7. Accordingly, the Writ Petition is dismissed.
