Heard the parties.
The petitioner has been made accused in connection with Latehar P.S. Case No. 54 of 2025, for the offence under Sections 96/3(5) of B.N.S., 2023 and Sections 8 & 12 of the POCSO Act, pending in the court of learned Special Judge, POCSO, Latehar.
On 21.01.2025, the daughter of the informant went missing. It is alleged that the petitioner and co-accused persons had enticed her away to leave her lawful guardianship with an intention to marry her.
The statement of the victim has been recorded under Section 183 of the B.N.S.S., in which, she has stated that she has left her lawful guardianship according to her own wish and wants to marry the petitioner.
This appears to be a case of adolescent love affairs between the parties.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO, Latehar, in connection with Latehar P.S. Case No. 54 of 2025.
