The present appeal has been filed under Section 374(2) of the Code of Criminal Procedure, 1973 against the impugned judgment of conviction and order of sentence dated 30.10.2021 passed by the SOURABH BHILWAR Digitally signed by SOURABH BHILWAR Date: 2025.09.19 19:17:50 +0530 2 learned Additional Sessions Judge, Second Fast Track Special Court Bilaspur, C.G. in Special Criminal Case (POCSO Act) No.48/2018 whereby the appellant has been convicted under Seciton 5(ठ)/6 of the POCSO Act and sentenced for life imprisonment and fine of Rs. 3,000/- with default stipulation. 2. On the last date of hearing, the counsel for the appellant submitted that the appellant herein has died during the course of treatment in the hospital. Therefore, the Superintendent of Police, Bilaspur was directed to verify the said fact by filing his personal affidavit. 3. In compliance with the order dated 17/09/2025 passed by this Court, whereby the Superintendent of Police, Bilaspur, was directed to file his personal affidavit informing this Court regarding the death of the sole appellant herein after due verification, the Senior Superintendent of Police, Bilaspur, has filed his personal affidavit along with the death certificate of the appellant. 4. Upon perusal of the affidavit and the death certificate, it is clearly established that the appellant – Sharda Prasad Kurre has died during the course of treatment at D.K.S Super Specialty Hospital, Raipur on 27.08.2025. 5.
