CRM(A) 2883 of 2025
An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023. And
In the matter of: Sambhu Nath Prasad … petitioner
Ms. Meghla Das … for the petitioner
Mr. Subhamoy Bhattacharya
Mr. Mainak Gupta
… for the State
Heard learned counsels for the parties. It appears that in the present case the petitioner was granted bail. After addition of a more serious charge, bail was cancelled and warrant of arrest was issued. As the petitioner was granted bail in connection with the same case, it is not anymore open to the petitioner to pray for anticipatory bail. Therefore, the application for anticipatory bail is dismissed as not maintainable. However, the petitioner shall be at liberty to pray for appropriate relief before the appropriate forum.
