ORDER 02.04.2026 1. By this petition, petitioner herein has challenged the order dated 22.01.2025, passed by the Divisional Commissioner, Kashmir, whereby, the detenue namely Mohd Shafi Sheikh @ Shafi Tractor S/O Gh. Hassan Sheikh R/O Sheikhpora Trehgam, District Kupwara, has been detained under the provisions of Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988. The said order was executed on 26.01.2025 2. Perusal of the reply reveals that the period of detention as prescribed in the order of detention was for a period of one year, which has expired on 25.01.2026. 3. In view of the above, the order of detention has outlived its life and the detenue, in consequence thereof, is entitled to be released from the custody. 4. Accordingly, while holding the petition as having become infructuous, it is ordered that the detenue namely Mohd Shafi Sheikh @ Shafi Tractor S/O Gh. Hassan Sheikh R/O Sheikhpora Trehgam, District Kupwara, be released from detention forthwith, if not required in any other case. 5. Disposed of.
