While so, the petitioners/accused Nos.1 and 2 did 3. not attend the Court on 18.04.2024 and the learned Sessions Judge issued Non-Bailable Warrants as against the petitioners/ 3 accused Nos.1 and 2 and thereafter, the matter was adjourned from time to time for execution of Non-Bailable Warrants. Learned counsel appearing for the petitioners/ 4. accused Nos.1 and 2 submitted that the issue between the parties is likely to be compromised by way of Memorandum of Understanding (MoU) at the intervention of both side elders. If, an opportunity is given to the petitioners/accused Nos.1 and 2, they would compromise the case, if not they would face the trial without there being any paucity in attenditig the Court. Heard. Perused the record. 5. In view of the aforesaid facts and circumstances. 6. this Court directs the petitioners/accused Nos.1 and 2 to file an application before the learned VIII Additional District and Sessions Judge-cum-Special Court for the trial of SCs and STs Cases, West Godavari at Eluru. On such application, the learned VIII Additional District and Sessions Judge-cum-Special Court for the trial of SCs and STs Cases, West Godavari at Eluru is directed to recall the Non-Bailable Warrants on the following terms and conditions; (1) The petitioners/accused Nos.1 and 2 shall execute personal bond for a sum of 4 Rs. 10,000/- (Rupees ten thousand) each with two (02) sureties for likesum each; (2) The petitioners/accused Nos.1 and 2 shall attend the Court on each and every adjournment, without fail; 7. It is needless to mention here that in case, the petitioners/accused Nos.1 and 2 do not make themselves available before the trial Court on any of the adjournment without filing appropriate application, till the disposal of the case, the trial Court is at liberty to proceed in accordance with law. 8.
