04/ 17.11.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Birni P.S. Case No. 84 of 2019, corresponding to G.R. Case No. 955 of 2021, registered under sections 420/406/409/34 of the I.P.C, pending in the Court of learned Judicial Magistrate, Ist Class, Giridih.

Learned counsel for the petitioner submits that petitioner is supplier of materials for construction of certain building under the MNREGA scheme. He further submits that allegations are made that there were certain irregularities in construction of building. He also submits that petitioner is only supplier of materials and other co-accused persons have already been granted anticipatory bail in A.B.A. No. 5656 of 2020 and A.B.A. No. 352 of 2020 and other A.B.As contained in annexure-2 series. He then submits that petitioner has got no criminal antecedent which is disclosed in para 13 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that there were certain irregularities in construction of building under the MNREGA scheme.

Considering that petitioner is supplier of materials for construction of certain building under the MNREGA scheme, other co-accused persons have already been granted anticipatory bail in A.B.A. No. 5656 of 2020 and A.B.A. No. 352 of 2020 and other A.B.As contained in annexure-2 series and he has got no criminal antecedent which is disclosed in para 13 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Giridih, in connection with Birni P.S. Case No. 84 of 2019, corresponding to G.R. Case No. 955 of 2021, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
