Heard the parties.
The petitioner has been made accused in connection with POCSO Case No.102 of 2025, arising out of Bhelwaghati P.S. Case No. 10 of 2025, for the offences registered under Sections 87, 64, 127(4), 61(2) of the B.N.S., 2023. Chargesheet has been submitted under Sections 96, 64(2)(m) of the B.N.S. and Section 4 of the POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. Petitioner is alleged to have enticed away 18 years old sister of the informant to leave her lawful guardianship with the intention to marry her. From perusal of the impugned order, it transpired that the statement of the victim was recorded and she has stated that she has left her lawful guardianship according to her own wish, she was having affairs with the petitioner. This appears to be a case of adolescent love affair between the parties. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO Act, Giridih, in connection with POCSO Case No.102 of 2025, arising out of Bhelwaghati P.S. Case No. 10 of 2025.
