By way of this petition, the petitioner has inter alia prayed for the following reliefs:-
“(A) A writ in the nature of mandamus or any other appropriate writ to direct the Respondents to act and disburse the sanctioned amount in terms of the sanction and recommendation for the Transportation subsidy vide diary No. 2321 for Rs. 11,21,550/- on 29.11.2022 and vide diary no. 1696 for Rs. 20,00,000/- on 29.11.2023, to the petitioner in terms of Clause 8 (V) (a) HP Industrial Policy 2019 r/w the Rules 2019.”

2. The Court stands informed in terms of instructions dated 05.12.2025, received by the office of learned Advocate General from the Director of Industries, Himachal Pradesh, relevant portion whereof reads as under:-
“This is with reference to your office letter No. CWP 17541/2025 dated 26.11.2025 on the subject cited above. The case was listed on dated 25.11.2025 and the Hon'ble High Court has directed as under:
"Learned Assistant Advocate General submits that he may be granted a week's time to file reply/instructions in the matter. List on 08.12.2025. Needful be done in the meanwhile."
In this context, it is to submit that necessary instructions have already been imparted vide letter of even No. dated 24.11.2025 (copy enclosed). The matter has already been taken up with the Government vide letter dated 20.11.2025 and the matter is under active consideration at the Government level and as soon as the budgetary provision is made by the Government/ Finance Department, this department will disburse the due amount to the petitioner without delay. In view of the above, since, approval from the Government is awaited, the amount will be disbursed on the receipt of sanction immediately, and, as such, it is, therefore, kindly requested to apprise the Hon'ble Court accordingly.”

Alongwith above instructions, instructions dated 24.11.2025, received from the office of Director of Industries, Himachal Pradesh, are also appended, relevant portion whereof, reads as under:-
“This is with reference to email dated 12.11.2025 on the subject cited above. The CWP was listed before the Hon'ble High Court on 12.11.2025 & respondents were directed to file reply within one week. In this regard, it is submitted that the claim amounting to Rs. 31,21,550/- of the petitioner pertains to incentives of Transport Subsidy (Rs. 11,21,550/- from 01.07.2021 to 31.12.2021 & Rs. 20,00,000/- for the FY 2023-24) which is not disputed. In addition, it is submitted that there is no availability of budget under Head of Account 2852-Industries-80- General-102 Industrial Productivity-09 S00N-Incentive to Industrial Units-63-subsidy, Demand No. 18 and matter for providing additionality of an amount of Rs. 31,21,550/- has been taken up with the Addl. Chief Secretary (Industries) to the Government of Himachal Pradesh vide letter dated 20.11.2025 (copy enclosed). The matter is under active consideration at the Government level and as soon as the budgetary provision is made by the Government, the

2025:HHC:46182 department will disburse the due amount to the petitioner and as such the directions, in this regard, are awaited from the Government. In view of the above, it is therefore, kindly requested that the Hon'ble Court may be apprised of the fact that the matter is under consideration and on the receipt of the directions from the competent authority, the amount will be disbursed without delay please. 4. Learned Senior Counsel for the petitioner in the backdrop of the contents of these instructions submits that this petition can be disposed of with the direction that now let needful be done by the Authorities expeditiously. Learned Senior Counsel has drawn the attention of the Court to the orders which are appended with the petition, in which similar direction has been passed by Hon’ble Division Bench of this Court. 5.
In light of the averments made in the petition and the instructions received and also orders relied upon by learned Senior Counsel for the petitioner in CWP No. 10560 of 2025, titled as M/s Salsan Steels Pvt. Ltd. vs. State of Himachal Pradesh and others, decided on 16.07.2025, this petition is disposed of with the direction that the respondents shall release the admitted amount in favour of the petitioner on or before 30.04.2026. In case needful is not done by the said date, then, respondents shall be liable to pay interest @ 6%

2025:HHC:46182 per annum from the date of this judgment till the date of payment. Pending miscellaneous applications, if any, also stand disposed of accordingly. (Ajay Mohan Goel)
