This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 181/2022 registered at Police Station – Bodhghat, District – Bastar (C.G.) for the offence punishable under Sections 307, 201, 294, 323, 324 and 506/34 of the Indian Penal Code (In short, IPC). 2. Case of the prosecution, in brief, is that on 11.08.2022 the applicant along with other co-accused persons have assaulted and injured one RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 Abhijeet Peter on a scufÒe which took place due to the vehicle being parked on road. On such complainant Police has registered the case against the applicant and arrested the applicant. Hence, this application. 3. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It has been further submitted that the applicant is in jail since 21.06.2024, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the present case is of the year 2022 and the applicant along with the co-accused persons is said to have assaulted the injured person with scissor on the back side lumber region, as per the MLC report there was an internal bleeding, and it is stated that the applicant was absconding in the present case and arrested by the Police on 21.06.2024 and the trial is under progress, and there is likelihood that the applicant will abscond if he would be allowed bail by this Court. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also the fact that the present case is of the year 2022 and the applicant along with the co-accused persons is said to have assaulted the injured person with scissor on the back side lumber region, as per the MLC report there was an internal bleeding, and it is stated that the 3 applicant was absconding in the present case and arrested by the Police on 21.06.2024 and the trial is under progress, and there is likelihood that the applicant will abscond if he would be allowed bail by this Court, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, this bail application of applicant – Karan @ Bhelwa involved in Crime No. 181/2022 registered at Police Station – Bodhghat, District – Bastar (C.G.) for the offence punishable under Sections 307, 201, 294, 323, 324 and 506/34 of the IPC, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
