Dhakar, PP Mr. Devanshu Sharma, for complainant HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 15/01/2025 1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioners, who have been arrested in connection with FIR No.397/2024 registered at Police Station Madanganj, District Ajmer for the offences punishable under Sections 191(2), 190, 115(2), 332(c) & 110 of BNS. During investigation, offences under Sections 191(2), 190, 115(2), [2025:RJ-JP:1978] (2 of 3) [CRLMB-16477/2024] 117(2), 332(c) & 110 of BNS have been found proved against the petitioners. 2. Learned counsel for the petitioners wants to withdraw the bail application qua the petitioner No.3 Fateh Chand. 3. Accordingly, the bail application is dismissed as withdrawn to the extent of petitioner No.3 Fateh Chand. 4. So far as case of petitioner Nos.1 & 2 are concerned, learned counsel submits that they have falsely been implicated in this case. Counsel submits that as per FIR, there is no specific allegation against these petitioners. Omnibus allegations have been levelled against the petitioners. Learned counsel contends that maximum punishment for alleged offences is seven years. It is contended that petitioners are female, they have no criminal antecedents and they are in custody since 15.12.2024. Trial will take time in its conclusion and further custody of the petitioners would not serve any fruitful purpose. 5. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by the counsel for the petitioners. They submit that petitioners are named in the FIR. Two grievous injuries have been found on the person of injured. 6. I have considered the contentions. 7. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, as also the fact that petitioners are female; they are in custody since 15.12.2024 and trial will take time in its conclusion, but without commenting anything on the [2025:RJ-JP:1978] (3 of 3) [CRLMB-16477/2024] merits/demerits of the case, I deem it proper to allow the bail application. 8. This bail application is partly allowed and it is directed that accused-petitioners (1) Sushri Gavrika Dhadhich D/o Shri Ashok Ji Dhadhich & (2) Smt. Anju Sharma W/o Shri Ashok Kumar Dhadhich, shall be released on bail provided they furnish a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
