1. Heard Mr. Pritam Kumar Tiwari, learned counsel for the petitioner. Also heard Mr. Sangharsh Pandey, learned Govt. Advocate appearing for the respondents/ State.
2. The present petition has been filed by the petitioner with the following prayer :-
“10.1 The Hon'ble Court may kindly be pleased to call for entire records pertaining to the case of the petitioner for it's kind perusal; 10.2 The Hon'ble Court may kindly set aside the
order dated 26.07.2024 passed by Upper Session Judge Jashpur, District Jashpur and issue a suitable writ, order or direction commanding the respondent authorities to consider the case of the petitioner for pre-mature release as early as possible preferably within a period of one month; and 10.3 Any other relief, which this Hon'ble Court may deem fit and proper looking to the facts and circumstance of the case, may also kindly be granted in favour of the petitioner.”

At the very outset, learned State counsel would submit that in the present petition, the petitioner has challenged the order dated 26/07/2024 passed by the Additional Sessions Judge, Jashpur whereby a negative recommendation was made against the petitioner, in spite of the order dated 08/05/2025 passed by the
3 Additional Secretary, State of Chhattisgarh whereby the claim of the petitioner for remission has been rejected to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to challenge the order dated 08/05/2025 by the authority concerned.
4. Learned State counsel has no objection.
5. In view of the above and the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for.
