order, dated 18.10.2024 passed in W.P. No.20324 of 2024. The ground urged before us by learned counsel for the appellants is that the writ petition, insofar as respondent No.5 was concerned maintainable as the 5*^ respondent, namely Sri Chebathina George Freed, had already passed away as early as 17.10.1995. was not On a perusal of the judgment and order impugned, it can be seen that none of the rights of the parties in the writ petition has been determined by the learned single Judge. Only direction was with regard to allowing the petitioner

No: 237 of 2025 V to file a representation before the 3'^'^ respondent i.e., District Collector, Nellore, who then was to provide an opportunity of being heard to the petitioner as well as 5^^ respondent (deceased Sri Chebathina George Freed) and pass appropriate orders within the period prescribed in the judgment. In our opinion, the controversy can as well be settled by modifying the
judgment and order impugned to the extent that instead of granting an opportunity of being heard to the 5*'' respondent, who has since passed away, the said opportunity be granted to the appellant No.2 herein i.e., Sri Chebathina Yesu Dasu, who is the legal heir of the deceased 5**^ respondent in the writ petition. The writ appeal is, accordingly, disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed.
