The petitioner (accused), who is being prosecuted for offences punishable under Sections 504, 507, 509, 354(C), and 385 of the IPC, is before this Court seeking relief. 3. The prosecution alleges that the petitioner (accused) abused the complainant using vulgar language, threatened her with dire consequences, outraged her modesty, and extorted money from her. 4. The parties are present before this Court and have filed an application along with an affidavit stating that they have amicably resolved the dispute among themselves. In terms of the settlement, respondent No.2 has agreed to withdraw all allegations made against the - 3 - NC: 2025:KHC:15558 CRL.P No. 82 of 2024 petitioner and has no objection to quashing the impugned proceedings, in order to maintain cordial relations and to avoid further hostility between the parties. 5. Although the offences alleged are cognizable and non-compoundable, considering that the parties have amicably resolved their dispute, subjecting the petitioner to trial would serve no meaningful purpose. The probability of conviction is remote and bleak, given the settlement. In the absence of any substantive evidence supporting the allegations against the petitioner, the continuation of criminal proceedings would amount to an abuse of the process of law. 6. Accordingly, the petition is allowed. The impugned proceedings in CC No.6112/2021 (Crime No.174/2020), pending before the learned 41st Addl. CMM Court, Bengaluru, is hereby quashed.
