Ms. Dipanwita Ganguly Ms. Susmita Chatterjee Mr. Masum Tarafder … for the respondent nos.8 to 11. 1. The petitioner seeks electricity supply at his residential premises. 2. A report has been field by the WBSEDCL authorities, which indicates that three connections exist at the relevant property all of which are in the name of the persons, who are no longer in the land of the living. 3. The report further reveals that the petitioner is enjoying electricity supply through the connection of late Jitendranath Singh and the petitioner’s premises is not electrically separated from others. 4. However, the report does not reveal that the petitioner is not living in a separate mess and the petitioner is not entitled to a separate metered supply or separate service connection. 5. The WBSEDCL authorities will, therefore, conduct
an inspection and find out if the petitioner is entitled to a separate metered supply or separate service connection. Such inspection will be conducted within a week from date upon notice to the petitioner and the private respondent. 6. The WBSEDCL authorities shall also explore if there is any alternative path through which the petitioner can be supplied electricity without disturbing the private respondents. If such alternative route can be ascertained or found out, the WBSEDCL authorities would proceed to effect electricity supply in favour of the petitioner subject to the petitioner complying with all necessary formalities and paying all necessary charges. 7. In case, the WBSEDCL authorities find that the petitioner is entitled to electricity supply but no alternative route is available then, in terms of Section 67 of the Electricity Act, 2003 read with Rule 3 of the Works of Licensees Rules, 2006, the WBSEDCL authorities would inform the petitioner about the same by a letter and also make a representation before the District Magistrate, Hooghly thereby requesting the District Magistrate to resolve the problem as regards alternative way for effecting electricity supply in favour of the petitioner. 8.
8. Such application should be made by the WBSEDCL 2
authorities to the aforesaid District Magistrate within a period of four weeks from date, in case, the petitioner is found to be entitled to separate electricity supply or service connection and alternative route is not found out. 9. Upon such application being made by the WBSEDCL authorities, the District Magistrate Hooghly shall draw appropriate proceedings, cause inspection to be conducted and pass a reasoned order, in accordance with law, within a period of six weeks from the date of making of such representation. 10. It is needless to mention that all inspections that would be conducted should be so done in presence of all parties upon advance notice and copies of the inspection report shall be made over to all the parties. All parties will be entitled to take exception to the report. 11. The reasoned order passed by the District Magistrate, Hooghly within the aforesaid period shall be communicated to all the parties within a week from the date of passing thereof. 12. In case, the WBSEDCL authorities face any resistance in conducting inspection or find out alternative route in terms of this order, the WBSEDCL authorities would be free to approach the respondent no.7 i.e. the Officer-in-charge of 3
Chandannagar Police Station for police assistance. If the Officer-in-charge of Chandannagar Police Station is so approached the said Officer-in-charge would afford adequate police assistance to the WBSEDCL authorities to act in terms of this order. Costs for such police assistance would be borne by the petitioner. 13. With the above observations, WPA 7049 of 2025 stands disposed of. There shall be no order as to costs. 14. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.) 4
