[2025:RJ-JP:8699] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No.16487/2024 1. Vijay Singh S/o Shri Jaisingh, Aged About 37 Years, R/o House No. B-8, Sudarshanpura, Kartarpura, P.s. Ashok Nagar, Jaipur. (At Present Confined In Central Jail Jaipur). 2. Vikki Dhanka S/o Shri Ramsingh, Aged About 24 Years, R/o House No. B-50, Shiva Colony, Tonk Phatak, P.s. bajaj Nagar, Jaipur (At Present Confined In Central Jail, Jaipur). ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ankit Sharma, Adv. For Respondent(s) : Mr. Jitendra Singh Rahtore, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 27/02/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.593/2024, registered at Police Station Mahesh Nagar, District Jaipur City (South), the offence(s) under Sections 8/22 of N.D.P.S. Act. 2. Learned counsel for the petitioners submit that the accused- petitioners have falsely been implicated in this case. It is contended that the recovery of M.D.M.A containing quantity of 187 gram was effected from the possession of other co-accused Rakesh Bansal and there is no recovery of any substance effected [2025:RJ-JP:8699] (2 of 3) [CRLMB-16487/2024] from the possession of the present petitioners. The petitioners in the present case have been solely implicated on the ground that they were apprehended with the other co-accused-Rakesh Bansal at the time of incident. The accused-petitioners are in custody since 11.12.2024, the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the accused-petitioners alongwith the other co-accused apprehended by the Police and thereafter, on search being made by the police officials 187 gram M.D.M.A was effected from the possession of other co-accused- Rakesh Bansal, which is beyond commercial quantity, therefore, considering the rider imposed under Section 37 of the N.D.P.S. Act, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. Admittedly, the M.D.M.A containing 187 grams was recovered from the possession of the co-accused Rakesh Bansal, and no recovery of any contraband article was effected from the possession of the present petitioners, there is no evidence to the fact that the petitioners were having knowledge that the other co- accused was carrying contraband articles in his pocket and considering the fact that the trial/investigation of the case may take considerable time therefore, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. [2025:RJ-JP:8699] (3 of 3) [CRLMB-16487/2024] 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioners- 1. Vijay Singh S/o Shri Jaisingh and 2. Vikki Dhanka S/o Shri Ramsingh, in connection with FIR No.593/2024, registered at Police Station Mahesh Nagar, District Jaipur City (South), shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
