02/24.11.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Chouparan P.S. Case No.245 of 2025, registered for the offence under Sections 317(5), 3(5) of the BNS and under Section 30(ii) of Coal Mines Act, pending in the Court of the learned J.M.F.C., Hazaribagh, Jharkhand.

Learned counsel appearing for the petitioner submits that the petitioner happened to be the owner of the pick-up van and the allegations are made that 50 sacks coal was loaded on the pick-up van. He submits that the father of the petitioner has left for heavenly abode on 28.08.2025 and the said coal was being carried for the personal use.

Learned counsel appearing for the State opposed the prayer and submits that the illegally, coal was being carried.

Considering that the petitioner is the owner of the pick-up van and it has been pointed out that the coal was being carried for the personal use and the father of the petitioner has left for his heavenly abode on 28.08.2025 and that coal was meant to be utilized for the preparation of the meal, I am inclined to extend the privilege of anticipatory bail to the

petitioner. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Hazaribagh, Jharkhand, in connection with Chouparan P.S. Case No.245 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
