Heard Sri Vidya Kant Tripathi, learned counsel for the petitioner and Sri Avneesh Tripathi, learned counsel appearing for respondent no. 3. 2. The prayer made in the instant petition is for a direction to the respondent-Authorities not to construct road over his plot bearing Arazi No. 222, Area- 0.5270 hectare, situated in Village Naini Taluka Naini Dadri, Pargana Arail, Tehsil Karchana, District Prayagraj, without formal acquisition and payment of compensation. 3. The petitioner claims to be owner of the aforesaid land. The allegation is that the respondents are threatening to take possession of his aforesaid land for purposes of widening Arail Bandha road without any formal acquisition. 4. Sri Avneesh Tripathi, learned counsel for respondent no. 3, on instructions from Prayagraj Development Authority, Prayagraj states that at present no work is being executed over the land of the petitioner. He submits that the authority would not disturb the possession of the petitioner without following the process of law. 5. Having regard to the aforesaid stand of the Development Authority, we dispose of the instant petition by providing that it would not disturb the possession of the petitioner from any part of his aforesaid land without following due process of law.
