N (P) AN JANA DEVI SATYANARAYANA Counsel for the.Respondent(S): 1.AS C BOSE The Court made the following JUDGMENT: The present appeal is preferred by the appellant-wife against the order and decree dated 07.08.2007 in OP No.277 of 2003 on the file of the Judge, Family Court, Visakhapatnam. The respondent-husband filed the said O.P. under Section 13 (1)(ia) of The Hindu Marriage Act-1955 seeking a decree to dissolve the marriage d^ted 12.11.1992 between the appellant and the respondent on the ground of adultery. The learned Family Judge after considering the oral and documentary evidence recorded a categorical finding with regard to the allegation of adultery and further that from 17.05.2003 onwards the appellant-wife and respondent-husband are living separately. The learned Family Judge accordingly allowed the O.P. and dissolved the marriage between the,parties. As the counsel for the appellant is no more notice was directed to the appellant to the address furnished in the cause title of the appeal, but the same was returned with an endorsement “No such addressee. Return to sender.” Be that as it may. It is represented by the learned counsel for the respondent that his counterpart appearing for the respondent-husband, in the OP, informed that .the respondent is no more. In the'aforementioned circumstances, this Court has no option, except to dismiss the matter. Accordingly, the Appeal is dismissed. No costs.
