This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.557/2024 registered at Police Station Mohan Nagar, District Durg, C.G. for the offence punishable under Sections 109(1) of BNS Act and GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.08.12 20:21:39 +0530

Case of the prosecution, in brief, is that on 02.11.2024 at around 8:20 .PM, the complainant Vikram Singh received a phone call from his brother's friends, Shubham and Ujjwal, informing him that his brother Aman Singh Pawar @ Nikku had been stabbed by the accused, Pranjal Yadav, and was being taken to the hospital. Upon reaching the District Hospital, Durg, the complainant inquired from his injured brother, who stated that while he was sitting near Gaura Chaura, Shankar Nagar with his friends, the accused Pranjal Yadav, due to old enmity, approached him and assaulted him with a knife with the intention to kill. As a result, Aman sustained injuries on his left rib, left arm, right knee, and below the navel. Based on this complaint, an FIR was registered and the applicant was arrested.

Learned counsel for the applicant submitted that the applicant is said to have assaulted the injured with knife who has suffered injuries below left scapular region, left shoulder, over right knee. He would submit that the applicant has criminal antecedents of 17 cases and out of 17 cases, 9 cases are old and stale when the applicant was a juvenile. He would submit that charge sheet has been filed in this case, the applicant is in jail since 03/11/2024 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant.
4. On the other hand, learned State Counsel opposes the bail application and she would submit that charge sheet has been filed in this case before the competent court. She would further submit that the applicant has criminal antecedents of 17 cases, therefore he is not entitled for grant of bail.

5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, nature of allegation levelled against the applicant, considering the fact that the applicant has criminal antecedents of 17 cases, his criminal antecedents goes to show that it starts from the year 2014 till 2024 and time and again he has misused the liberty of bail, though 9 cases are stated to be old and stale when the applicant was a juvenile but considering the criminal antecedents of the applicant, he is an habitual offender, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of applicant Pranjal Yadav @ Sultan involved in Crime No.557/2024 registered at Police Station Mohan Nagar, District Durg, C.G. for the offence punishable under Sections 109(1) of BNS Act and 25, 27 of Arms Act, is rejected.
8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
