JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 3 23-07-2025 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant. 2. The petitioners apprehend their arrest in connection with Katoriya P.S. Case No. 232 of 2024 instituted under Sections 126(2), 115(2), 109, 303(2), 351(2) and 3(5) of Bharatiya Nyaya Sanhita. As per the prosecution case, on 05.10.2024, during course of measuring land, these petitioners assaulted the informant and his family members by means of axe, sword and iron rod as a result of which, the informant and his family members sustained injuries. 4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. As a matter of fact, during measurement of land an altercation took place between the parties in which both sides sustained injuries. There is case and counter case between the parties. Injuries sustained by the informant and his family members are simple in nature. Petitioners have got clean antecedent and they undertake to cooperate in the investigation and trial. 5. Learned A.P.P. for the State and learned counsel for the informant oppose the prayer for anticipatory bail. 6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the Patna High Court CR. MISC. No.30293 of 2025(3) dt.23-07-2025 3/3 satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Katoriya P.S.
