The present application under Section 528 of Bhartiya Nagarik Suraksha Sanhita (hereinafter referred as 'BNSS') has been preferred against the recovery warrant dated 17.09.2024, issued by learned Principal Judge, Family court, Bulandshahr in misc. case no. 257 of 2024, under Section 125(3) Cr.P.C., arising out of maintenance case No. 671 of 2021, under Section 125 Cr.P.C., P.S. Aurangabad, district Bulandshahr. 3. After arguing at some length, learned counsel for the applicant submits that the prayer made above is not being pressed and the applicant may be permitted to deposit the arrears of maintenance in installments. 4. In view of the aforesaid, it is directed that in case applicant moves an application before the Family Court concerned within a period of two weeks from today for paying/depositing the arrears of maintenance in installments, the same shall be considered and decided expeditiously in accordance with law. 5.
