The testatrix is survived by three legal heirs who have been described in paragraph 8 of the application. The husband of the testatrix is the executor and the applicant. The two sons of the testatrix (who are the remaining legal heirs apart from the husband) have consented to the grant by filing affidavits of consent. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the petition.
