ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“… pleased to issue an appropriate writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents especially respondent No.3 in issuing the impugned demand Notice NO.56/Q/2021 dated 2.11.2024 with regard to the mining lease granted vide proceedings No 4458/Q1V/2018
dated 5.01.2023 without considering the representation of the petitioner dated 28.09.2024 in true spirit and in accordance with procedure contemplated under law and to declare the same as illegal arbitrary unjust discriminatory highhanded and also in violation of principles of natural justice and consequently set aside the impugned demand Notice No 56/Q/2021 dated 2.11.2024 issued by the 3rd respondent and direct the respondents to follow the procedure contemplated under law and pass….…….”
2. Heard Mr G.L.Nageswara Rao, learned counsel for the petitioner and Smt.P.Sudeepthi, learned Assistant Government Pleader for Mines and Geology appearing for Respondents.
3. On hearing, learned counsel for the petitioner submits that the matter is squarely covered by the order passed by this Court in W.P.No.24660 of 2024, dated 28.10.2024, and hence, requests this Court to pass similar
order in this petition also. The operative portion of the said order is as follows:-
7. Accordingly the impugned Demand Notice bearing No.647/Q/2024-38, dated 20.08.2024, issued by the 3rd respondent is hereby set aside. The 3rd respondent is
directed to consider the explanation submitted by the petitioner on 07.06.2024 and pass appropriate reasoned orders in accordance with law after affording opportunity to the petitioner herein within a period of three (03) months from the date of receipt of a copy of this order.
4. Learned Assistant Government Pleader for Mines and Geology appearing for the respondents opposed for grant of any relief in the writ petition and prayed to dismiss the same.
5. In view of the submission made by both the learned counsels and upon perusing the entire material available on record, this Court deems fit to dispose of the present Writ Petition in terms of the said order.
6. Accordingly, this Writ Petition is disposed of in terms of the order passed in W.P.No.24660 of 2024, dated 28.10.2024. There shall be no order as to costs.
7. The Registry is directed to attach a copy of the order passed in W.P.No.24660 of 2024, dated 28.10.2024 to this order.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
